NOVEMBER, 2006 COUNCIL MINUTES
NOVEMBER 9, 2006
1. CALL TO ORDER AND ROLL CALL: Mayor Beckstead called the
meeting to order at 2:00 p.m. Mayor Beckstead and Councilors Kelly, Hanes,
Woodruff, Welch, Campbell and Church answered the roll. A quorum was present.
2. CITIZEN COMMENTS AND CONCERNS: Genie Papas addressed the Council regarding
her concerns about the increased development in Waldport and the effect it would
have on infrastructure, taxes, and safety services. Tom Cropper addressed the
Council regarding his concerns about increases in population and the effect of
increased development on the environment.
3. COUNCIL COMMENTS AND CONCERNS: Mayor Beckstead congratulated Councilor Welch
on his successful campaign to become the next Mayor of Waldport. Councilor Welch
thanked the voters of Waldport for their confidence in his ability to serve. Ms.
Leonard explained that the County Clerk noted there were 166 write-ins, though
the name of the successful candidate is not yet available. If the person decides
that they do not want to sit on the Council, the Council will appoint someone to
the next practicable election.
4. MINUTES: The Council considered the minutes from the October 12, 2006
meeting. Councilor Church moved to approve the minutes as presented.
Councilor Woodruff seconded, and the motion carried unanimously on
a voice vote.
5. PUBLIC HEARING: None.
6. STAFF REPORTS:
A. Sheriff: Deputy Bruster addressed the Council regarding
recent activity in the Sheriff’s Department. He commended the local liquor
establishments on the significant drop in the number of DUII’s in the previous
two months. Deputy Bruster is putting together a Traffic Safety Project, and
asked the Council for their support. The School District, Oregon State Police,
ODOT, and State Farm Insurance are participants. Officer Bruster stated that he
will be issuing tickets for 10 miles over the speed limit. He commented on the
positive effect of the sidewalk on Cedar Street on traffic, and Councilor Kelly
noted that Ms. Papas was one of the persons responsible for getting the sidewalk
installed. Following a brief discussion, Councilor Welch asked Ms. Leonard to
look into the pros and cons of a local traffic school.
B. City Manager: Ms. Leonard mentioned the City Attorney’s
recommendation that Councilors not attend the upcoming Planning Commission
public hearing. Any Council members who do decide to attend will need declare
ex parte contact if the case were to subsequently be heard by the Council.
C. Public Works Superintendent: Ms. Leonard gave the Public
Works report, noting that the City weathered the recent storms quite well. The
lagoon dredging project is now on hold because of the weather, so DEQ has
extended their permissions to the 20th of the month. Councilor Welch
asked about water rights, indicating it was his understanding that the Oregon Department of Fish and Wildlife (ODFW) was now
involved in the process. Ms. Leonard responded that permits issued by the Water
Resources department are now approved by ODFW to ensure that whatever is done
will not hinder fish passage. This has slowed the approval of some extension
requests, but she was not aware of it actually stopping the process. She noted
that the flow analysis on Southworth Creek showed the average flow is 3.5 CFS,
which is more than sufficient to provide the City with the required 1.5 CFS.
Councilor Welch asked her to keep the Council advised. Councilor Church asked
about the sewer line to McKinley’s Marina. Ms. Leonard responded that the
engineers have determined the direction of the bore, easements are being
obtained, and permits have been issued by DSL, ODOT, and the Army Corps of
Engineers. The property owner is paying for a 4" sewer line and installing their
own pump station. Urban Renewal will be paying for the accompanying water line
and the cost difference of increasing the size of the sewer line from 4" to 8".
7. COMMITTEE REPORTS: None.
8. INFORMATIONAL ITEMS: The Council considered the Library
minutes and circulation report, the Planning report, and the Municipal Court
report. There were no questions.
9. CONSENT CALENDAR: There were no items in the Consent
Calendar.
10. DISCUSSION/ACTION ITEMS:
A. Consideration of Annexation Request: Ms. Leonard explained
that this was an additional piece of property to be added to the Naples project.
Hearing no objections, Mayor Beckstead read Ordinance No. 711 by title only for
first and second readings. Councilor Church moved to
approve the ordinance as read. Councilor Kelly seconded. The motion
carried unanimously on a voice vote. A brief discussion ensued regarding
road access, and the possible relocation of Urban Renewal boundaries to exclude
green space and include the higher density properties.
Councilor Church commented that the proper relocation of
property lines are creating difficulties for downtown owners. Ms. Leonard
indicated that, in some cases, property lines can be adjusted between property
owners.
B. Amendment of Municipal Code to Add Section on Deteriorated
Buildings: Ms. Leonard stated that the City Attorney had drafted language to
provide the City with authority to deal with buildings such as the mercantile
building. The original ordinance, with the proposed changes, had been included
in the packet materials. Discussion ensued. The Council proposed a couple of
minor changes to the ordinance, with regard to restrictions on occupancy, and
time limits for compliance. Ms. Leonard indicated those changes would be made,
and the completed ordinance would be brought to the Council for consideration at
their December meeting.
C. Other Issues: None.

12. ACTIONS, IF ANY, FROM EXECUTIVE SESSION: None.
13. GOOD OF THE ORDER: Nothing further.
14. ADJOURNMENT: At 3:30 p.m., there being no further
business to come before the Council, the meeting was adjourned.
