1.
CALL TO ORDER AND ROLL CALL: Council
President Moore called the meeting to order at 7:00 p.m.
Council President Moore and Councilors Church, Searcey and Moore
answered the roll. Mayor Lehmann
and Councilors Peterson and MacGregor were absent.
A quorum was present.
2.
CITIZEN COMMENTS AND CONCERNS: Howard
Uhl, from Pacific View Drive addressed the Council in appreciation of the work
which the Public Works crew had recently performed.
Susan Woodruff, from Maple Street, addressed the Council in
appreciation of the work which the Public Works crew had recently performed on
the installation of speed ramps on Maple Street.
3.
COUNCIL COMMENTS AND CONCERNS: Councilor
Church noted that he had ridden with Deputy Endicott recently, and praised the
Sheriff's Department for the work which they are doing.
Councilor Searcey mentioned she had experienced the speed bumps on
Maple Street and they appeared to be effective.
Councilor Welch asked the Council if they were interested in having him
pursue the idea of bringing natural gas to South County.
Consensus was favorable. Council
President Moore noted two items not on the agenda.
One was an inquiry from Cynthia Anderson, widow of the late Judge
Anderson, wondering if the City would be interested in a donation of his desk,
to be used in one of the City offices. Consensus
was favorable. The second
item was in regards to receipt of a letter from the Waldport Ranger Station in
regards to the proposed consolidation of the Waldport, Florence and Reedsport
stations into one station, which would be located in Florence.
The result of this relocation would be the loss of 25 to 30 jobs in
South County. Consensus of
the Council was to have Mr. Dowsett contact the Ranger Station in regards to
the possibility of relocating the consolidated station here in Waldport.
Council President Moore also noted the large public hearing notice
which was being mailed out the following day, in regards to the public
hearings scheduled for August 24 at 5:30 in regards to the expansion of the
Urban Growth Boundary, the Riparian Overlay Zone, and the proposed revisions
to the Development Code. The
final issue raised by Council President Moore was a request from Councilor
Church to attend a training on websites in Eugene.
Councilor Welch moved to have Councilor Church attend, Councilor
Searcey seconded, and the motion carried unanimously on a voice
vote.
4.
MINUTES: The Council considered the minutes from the July 6, July 11
special meeting and July 11 regular meeting.
Councilor Searcey moved to approve the minutes as presented.
Councilor Welch seconded, and the motion carried
unanimously on a voice vote.
5.
STAFF REPORTS:
A. Sheriff Report: Lt.
Stallard was present to answer any questions in regards to the written report.
No questions were presented.
B. City Administrator: Mr.
Dowsett noted that he had spoken with Ray Bartlett that day in regards to the
final draft of the rate study and SDC's which would be forthcoming after a few
questions to staff. Mr. Dowsett
had noted that a request had been made by an employee for a payout of vacation
time. Consensus of the
Council was to refer the issue to the Finance and Administration Committee.
Mr. Dowsett noted that Dahl's Disposal had offered the use of a
dumpster if the City/Urban Renewal Agency would pay the dump fees to Coffin
Butte. Consensus of the
Council was to have Mr. Dowsett pursue the issue.
Mr. Dowsett noted that the City had made the final cut for the RARE
program. Councilor Searcey asked
about the status of the letters for the faulty windows at the Senior Center,
the response to Ocean Hills regarding a request to maintain the vegetation and
the letter regarding the relocation of the weigh station.
All still needed to be written.
C. City Attorney: Mr.
Hammersley gave a brief update regarding Handy Haven, noting that he was
filing a motion for order of default, and stating that the property was up for
foreclosure sale in September. He
noted that discussion regarding the Sagaitis lawsuit would take place in
Executive Session.
D. City Engineer: No report.
E. Public Works Director: Mr.
McClintock gave a brief update regarding the progress on storm drains and road
repairs. He noted that the City
was still gravity feeding the water plant from the North and South
impoundments, no pumping from Eckman was required.
This was a definite improvement over years past.
He then reviewed the other activities in the Public Works Department.
Councilor Moore stated that he had heard nothing but good comments
regarding the crew.
Noting the presence of the architect, the Council determined to move
the Keady Wayside Park discussion up on the agenda.
The architect, Melica Dedijer, addressed the Council regarding the
plan. She noted that they needed approval at the meeting that
evening, in order to avail themselves of the OYCC funding and personnel.
Discussion ensued regarding the placement and location of the viewing
station, the design, and the personnel that would be involved in the site
preparation and finish work. Councilor Searcey moved to approve the plan as
presented, with final design approval from the Council.
Councilor Church seconded.
The motion then carried unanimously on a voice vote.
6.
COMMITTEE REPORTS:
A. Finance and Administration: Councilor Searcey gave a brief review of
the issues from the Finance and Administration meeting, noting that they had
reviewed a software demonstration. Councilor
Church had volunteered to follow up on the issue with Ms. Lawson.
Councilor Searcey noted that reports on the transient rental policy,
business license fees and the Senior Center policy would be ready by
September.
B. Infrastructure and Planning: Councilor
Moore gave a brief review of the minutes from the Infrastructure meeting.
He noted one additional item was to have Mr. Dowsett respond to Seal
Rock Water District regarding their concerns about the upcoming public hearing
process. The Committee had
recommended that the Wastewater Collection Plan be referred to the September
meeting for approval. The recent
draft report from Ray Bartlett had included a recommendation that the City
look at a water rate increase possibly in the next fiscal year.
Councilor Welch gave a brief update on the tsunami siren installation,
which would take place in a couple of weeks.
C. Parks & Recreation: The
issue of the viewing platform at Keady Wayside was previously addressed.
7. CONSENT CALENDAR: The
Council considered the following items: City
Engineer Bill from June, 2000; Economic and Financial Analysis Bill from July,
2000. Councilor Searcey moved
to approve the Consent Calendar, Councilor Welch seconded.
The motion carried unanimously on a voice vote.
8. CORRESPONDENCE: The
Council considered the following items: a
letter from Census 2000 and a letter from Betty Lattie.
No further action was needed.
9. INFORMATIONAL ITEMS: The
Council considered the following items: Municipal
Court report from July, 2000; Senior Center Board minutes from July 17, 2000;
Library Board minutes and monthly circulation report.
No further action was needed.
10. NEW
BUSINESS:
A. Library Contract: Librarian
Tierce was present to address the Council in regards to the contract. She explained that the contract, as corrected, included the
fact that the District would be paying the CRSN dues on behalf of the Library,
rather than taking that out of the $42,900 allocation.
This would be about $10,000 to the City's advantage.
Councilor Searcey moved to approve the contract, Councilor Welch
seconded, and the motion carried unanimously on a voice vote.
Ms. Tierce also noted that the Friends of the Library had made over
$1000 in their recent book sale, and signed on several new members as well.
B. Considerations of Library Board Recommendations:
Ms. Tierce noted that there were two recommendations from the Board,
one in regards to approval of the Library contract, the second in regards to
appointment of a Council member to the Library Board.
Councilor MacGregor had been the Council liaison, but had not been able
to make several of the meetings. Following
a brief discussion, consensus of the Council was to appoint Councilor
Moore as the pro tem liaison, until Councilor MacGregor could be asked about
his interest in continuing.
C. Approval of City Membership to Chamber of Commerce:
Following a brief discussion, Councilor Welch moved to approve
the payment of the $100 membership fee. Councilor
Church seconded, and the motion carried unanimously on a voice
vote.
D. Discussion re Disposition of Rebel Road Property:
Following a brief discussion, it was determined that further discussion
and information was needed before a decision could be made.
Staff was asked to provide a map to the Councilors so they could ensure
they were viewing the correct property.
12. OLD
BUSINESS: None.
13. EXECUTIVE SESSION(S): At
8:15 p.m., the Council recessed into Executive Session, pursuant to ORS
192.660 (1)(h): To consult with counsel regarding current litigation or
litigation likely to be filed; and ORS 192.660(1)(e): To conduct deliberations with persons designated by the
governing body to negotiate real property transactions.
The Council reserved the right to return to open session.
14. ACTIONS, IF ANY, FROM EXECUTIVE SESSIONS:
None.
15. ADJOURNMENT: At 9:25 p.m.,
there being no further business to come before the Council, the motion to
adjourn was made, seconded, and carried unanimously.

2.
DISCUSSION REGARDING KEADY WAYSIDE PROJECT:
Mayor Lehmann explained that the purpose of the meeting was to discuss
the necessity for adopting a resolution which would declare an emergency and
allow the City to accept a bid for concrete work from Glenn Mecum
Construction. Discussion ensued regarding the legality of the proposed
action. Following discussion,
Councilor MacGregor moved to adopt Resolution 960, Councilor Searcey seconded,
and the motion carried on a voice vote, with Mayor Lehmann and
Councilors MacGregor, Church, Welch and Searcey voting "Aye",
Councilor Peterson voting "Nay".
Discussion
ensued regarding the needed easements at the Crestview Hills Golf Course.
Consensus of the Council was to proceed with the survey of Range
Drive and the Golf Course Property for the new easements.
3.
ADJOURNMENT: At 5:35 p.m., there being no further business to come before
the Council, the motion to adjourn was made, seconded, and carried
unanimously.

ROLL CALL: Mayor Lehmann
called the meeting to order at 5:35 p.m.
Mayor Lehmann and Councilors Church, Peterson, Searcey, MacGregor,
Moore and Welch answered the roll. A
quorum was present.
2.
PUBLIC HEARING: Land Use
Matters (Periodic Review Tasks): Mayor
Lehmann opened the public hearing at 5:36 p.m.
A. STAFF REPORTS: City
Administrator Dowsett asked for a show of hands in regards to the issues at
hand. Approximately 300 people
were present at the hearing. Most
of the people present were there to address the Urban Growth Boundary
expansion. Mr. Dowsett gave a
brief review of the process, noting that the City had already expended some
$20,000 in Periodic Review before the latest legislative session excluded
cities of less than 2500 people. He
explained that the requirements of Measure 56 included notification to all
property owners who would be impacted by the decisions of the Council in
regards to those periodic review tasks.
Mr. Dowsett noted that Goal 11 requires that extension of sewer
services cannot take place outside of urban growth boundaries.
The issue of the Urban Growth Boundary would include a public hearing
process for the City and another for the County, and if and when they both
agree, it then goes to the Land Conservation and Development Commission (LCDC)
for a decision. Part of the
Wastewater Collection System Master Plan was required by DEQ in order to
address the existing problems in the city's collection system, as well as a
proposed expansion in conjunction with the UGB.
Mr. Dowsett reiterated that the record would not be closed at this
meeting, and deliberations would take place at the September 21 meeting.

costs for wastewater services and whether the existing facility could handle
the increased load, as well as whether hooking up to the system would be
required if it came within a certain distance of the property. After hearing the testimony, Mayor Lehmann noted that the
hearing would be recessed to September 21 at 5:30 p.m., and the record would
remain open for additional testimony.
C. Proposed Adoption of a Natural Resources
Overlay Zone for Wetland and
Riparian Corridors: At 8:36
p.m., the Council addressed the second item on the public hearing, the
Natural Resources Overlay Zone Ordinance.
The following persons submitted testimony in writing to be included

At 8:50 p.m., the Council then took up the third and final item on
the public hearing, the amendments to Title 16 of the Waldport Municipal
Code.
One piece of correspondence was received in regards to this issue,
from Jon Wiest, property owner in Peterson Park.
No citizens were present to address the Council.
It was determined that there may have been people there earlier to
comment on the proposed changes, but they had evidently left, assuming that
the issue might not even come up that evening.
Councilor Welch moved to recess the public hearing, as well as
any deliberations or decisions to a time certain, September 21, 2000 at 5:30
p.m. in the Waldport Annex gymnasium. Councilor
Moore seconded. The
motion then carried unanimously on a voice vote.

ADJOURNMENT: At 8:56 p.m., there being no further business to come before
the Council, Councilor MacGregor moved to adjourn, Councilor Moore seconded,
